TOPIC: “How D&O Insurance Companies Try To Get Out Of Paying Claims… And Ways Policyholders Can Fight Back”
In recent years, bet-the-company-scale class actions and derivative shareholder actions have become increasingly popular tools to attack corporations. While corporations buy Directors & Officers insurance policies to maximize their protection against such risks, the insurance companies selling those policies have become more aggressive in finding ways to avoid paying large claims. This presentation will address ways by which policyholders can fight back against coverage denials, and how they can avoid many of those problems in the first place. Policyholders will learn: (a) how common exclusions in D&O policies can be avoided, (b) how to maximize payment from your D&O tower, and (c) how to apply pressure on the carrier to pay your claim.
