DESCRIPTION:\nTopic: “I’m a Believer—Key Considerations for In-House Lawyers regarding Texas Rule of Civil Procedure 91a and the Believability Standard for Early Dismiss in Texas”.\n \n \n \nSpeaker is Brandon A. Fuqua of Sidley Austin LLP in Dallas:  http://www.sidley.com/people/brandon-a-fuqua\n \n \n \nDescription of his presentation:\n \n \n \nTexas Rule of Civil Procedure 91a provides for the dismissal of baseless causes of action. While some courts have likened Rule 91a to a state-court analogue of Federal Rule of Civil Procedure 12(b)(6) (dismissal for failure to state a claim), there are some important differences to be aware—such as Rule 91a’s “loser pays” provision and strict procedural requirements. The presentation will help lawyers identify when using 91a would be appropriate, discussion of some key considerations when litigating under Rule 91a, and practical guidance on how to proceed or defend against a Rule 91a motion to dismiss.\n \n \n \n1 hour MCLE credit (CCBA Members Only).\n \n \n \nLocation:  Abuelo's in East Plano, 3420 N. Central, north of Parker Rd.\n \nCost:  $15 including tax and tip for fajita buffet, tea and water\n \n \n \nFor additional details, please contact Anne Shuttee, anne.shuttee@shutteelaw.com or Martha James, mjames@holtjameslaw.com (Co-Chairs).\n
