DIRT, DEATH, AND FAMILY: THE INTERSECTION OF THE TEXAS PROPERTY, ESTATE, AND FAMILY CODES WHAT REAL ESTATE LAWYERS NEED TO KNOW
Real estate practitioners often come across a variety of legal issues that impact real property. A client’s marital status, impending divorce, a death in the family, or a host of other common personal circumstances will cause the everyday real estate lawyer to be faced with provisions found in probate and family law practice. This paper will identify common intersections between the Texas Property, Probate, and Family Codes by discussing applicable law, common situations where those intersections occur, and when it may be good to associate family or probate counsel on a deal.
