ESTATE PLANNING/PROBATE SECTION MEETING

Topic: Representing Clients with Borderline Capacity
The presentation will cover the basic of inquiring about and determining a client’s capacity at the time of engagement and through an ongoing representation. The presentation will deal with the strategies for determining capacity and dealing with an ongoing client who has diminishing capacity. In addition to dealing with these issues, the presentation will look and discuss the attorney’s responsibility in situations of questionable client capacity and the potential consequences of failing to be vigilant regarding a client’s capacity in the context of planning and litigation.
