TOPIC: CRIMINAL LAW, CIVIL LITIGATORS, CRIMES CONVICTIONS & THE FIFTH AMENDMENT
SPEAKERS: JUDGE PIPER MCCRAW AND MICHAEL PEZZULLI
This program covers the exposure of civil lawyers to potential criminal exposure, both for their clients as well as the attorney. First, how can a civil lawyer get caught up in the crime of money laundering under 18 USC §§ 1956 and 1957. Second, when the federal government is involved, being less than honest can get you both fined and imprisoned for up to five years, or both under 18 USC § 1001. Third, you may be required to file what is called a CTR under the Currency and Foreign Transaction Reporting Act, 31 USC §§ 5311-5326. Included in the definition of “financial institution” are “persons involved in real estate closing and settlements. This law applies to transporting more than $10,000 at one time where one location is outside the United States. Fourth, what is Parallel Prosecution and why you must have a good working understanding of the Fifth Amendment to the United States Constitution.
