Description of his presentation:

 

Texas Rule of Civil Procedure 91a provides for the dismissal of baseless causes of action. While some courts have likened Rule 91a to a state-court analogue of Federal Rule of Civil Procedure 12(b)(6) (dismissal for failure to state a claim), there are some important differences to be aware—such as Rule 91a’s “loser pays” provision and strict procedural requirements. The presentation will help lawyers identify when using 91a would be appropriate, discussion of some key considerations when litigating under Rule 91a, and practical guidance on how to proceed or defend against a Rule 91a motion to dismiss.
