CORPORATE COUNSEL SECTION VIRTUAL MEETING

NOVEMBER 12, NOON

TOPIC: Impasse as an Opening: Reframing a Negotiation Barrier into a Pathway for Insight and Creativity.

Negotiation impasse feels like failure. Progress towards agreement halts and parties may abandon their pursuit of resolution. For decades, Dispute Resolution scholarship focused on how to break, avoid or otherwise prevent this undesirable outcome. What if impasse is, instead, an opportunity to generate creativity? And what if negotiation creativity happens because we stop problem-solving?

SPEAKER: Laura Frase, J.D., M.A.

Laura Frase incorporates a 100 year old learning and cognitive science theory with negotiation theory, reimagining a well known perceived negotiation barrier. She proposes a process that may help negotiators transform impasse from failure to a critical juncture where learning, creativity and insight become possible for the parties. Impasse is no longer an obstacle. Impasse may become creativity’s ally.
